Ryan O'Neal Defamation Lawsuit Challenged in New Court Filing (Exclusive)

Rodriguez/Getty Images The film/TV producer sued for defamation by Ryan O'Neal has fired back at the actor, claiming in a strongly worded court filing that the lawsuit based on comments concerning a fight over artwork once owned by O'Neal ex Farrah Fawcett should be dismissed. Craig Nevius, who produced a TV show about the late actress (Chasing Farrah) and worked on a documentary about her fight against cancer, claims in a motion filed Thursday that O'Neal wrongly sued him for excercizing his free speech on an issue of public concern. For those late to the story, O'Neal was sued in July by the University of Texas, which claims that Fawcett bequeathed it all of her artwork when she passed away in 2009. The Fawcett artwork includes an Andy Warhol portrait that O'Neal claims is his. When Nevius, who was friendly with Fawcett before she died, spoke out about his knowledge of Fawcett's artwork and helped the university with its case, O'Neal sued him for $1 million for defamation. O'Neal, who the motion says is "now better known for his womanizing, drug abuse, various criminal arrests and savage beatings of his children," argued that Nevius's statements in Star magazine and on Good Morning America defamed him. Now Nevius is fighting back, filing a motion under California's anti-SLAPP statute, which allows for certain lawsuits concerning public speech to be dismissed at an early stage. Nevius claims O'Neal's lawsuit is wrong because he never told the university or the investigators that O'Neal had "stolen" anything. "Nevius never stated to any reporter that O'Neal had 'stolen' or 'concealed' the Warhol portrait and never said that there was any 'police' investigation of O'Neal," according to the motion. Nevius says the real reason for the lawsuit is clear: "to get Nevius to stop providing information that he has which appears to evidence the fact that O'Neal was not prepared to deal with Ms. Fawcett's passing without a $30 million souvenir." O'Neal recently asked for more time to respond to the University of Texas lawsuit. The new filing also includes three declarations, from Nevius (who describes a whole bunch of crazy behavior on O'Neal's part) as well as Fawcett's former personal assistant Mike Pingel and her longtime friend Gregg Lott. In his declaration, Lott says O'Neal's contention that Warhol made one of the portraits for him is not true. "Farrah always had possession of both Warhol portraits from the day they were created and they were unquestionably owned by her and her alone," Lott's declaration states. We've put in a call to O'Neal attorney Marty Singer and will update with a response. UPDATE: "We don't believe this is a case that subjects itself to anti-SLAPP," Singer tells us. Relativity sets China coprod venture with Huaxia Film

KavanaughRecognizing the increasing importance of the Chinese entertainment market, Relativity Media has inked a strategic partnership with Huaxia Film Distribution Co. and SkyLand (Beijing) Film-Television Culture Development and, separately, is teaming with SAIF Partners and IDG China Media to launch the first Chinese-American distribution company, SkyLand Entertainment. Producer/distributor Huaxia is one of the two main conduits for U.S. theatrical releases in China, while SkyLand is a prominent Chinese production, financing and distribution shingle. SkyLand will distribute all of Relativity's future films in China, including "Immortals," "Haywire," "The Raven," the Navy SEAL pic "Act of Valor" and its untitled Snow White project starring Julia Roberts. Noting that China is the fastest-growing film market in the world, with more than 6,000 screens and better than $1.5 billion in box office revenue last year -- an increase of more than 60% last year alone -- Relativity CEO Ryan Kavanaugh said, "We're excited to be entering into this booming market with such great partners in SAIF, IDG and our new strategic partnership with Huaxia. Given the substantial platform created by SAIF and IDG in SkyLand, we believe together we can grow a distribution business in China which brings global product to China, and brings Chinese product to the global market." Though co-productions are exempt from China's quotas on foreign films, they are subject to a strict censorship process, which has made the market a tough nut to crack for Hollywood. It's not clear if this new partnership will be exempt from the quota system or get around it in some way. Relativity will work with SAIF and IDG to develop, produce, distribute and acquire Chinese material that possesses worldwide appeal. SkyLand is jointly owned by Relativity Media, SAIF Partners and IDG China Media. Company is also partnered with a China-based RMB fund to co-invest in local film and TV content and production, with the deal valued at $100 million. The trio are already working on several projects that will bring Chinese folklore to theaters in the U.S. and worldwide. Formed by SAIF and IDG more than two years ago, SkyLand recently co-produced Wayne Wang's "Snow Flower and the Secret Fan." Kavanaugh attended the Beijing press conference along with Huaxia Film's exec chairman Guoqing Gu, SAIF Partners' managing partner Andy Yan and IDG China Media's founding partner Hugo Shong. Joint venture aims to accelerate the pace of co-production between the U.S. studio and its Chinese counterparts. Relativity, SAIF and IDG are working on big-budget titles based on famed events from China's past. Purpose is to create movies that will appeal to Chinese and Western auds and solidify a more fluid film partnership between the U.S. and China while creating strong returns for those investing in the new business. "This partnership will broaden the cooperation platform, introducing significant resource for the co-production of future movies and allowing us to build on valuable movie production experiences from overseas," Gu said. "Meanwhile, such a partnership will also open the channels for Chinese movies to air globally and offer international audiences a better understanding of Chinese culture." Yan, managing partner of SAIF and a large investor in SkyLand and Relativity said: "Until now, there has been a major void in bridging the two worlds of the American and Chinese film industries. After spending significant time learning about Relativity's business and how they approach the international markets, we couldn't be more pleased to have entered into what will undoubtedly be a revolutionary shift in the China film business as we know it." Shong, founding general Partner of IDG China Media and a co-financier of SkyLand, said: "We couldn't be more excited about creating this revolutionary partnership, and simultaneously entering into a strategic partnership with Huaxia." Spike Picks Up John Langley Cop Show, 3 Other Reality Series, Renews 'Repo Games'

Spike TV has greenlighted four new reality series: Undercover Stings from Cops creator John Langley, about cops orchestrating sting operations; Big Easy Justice from Al Roker and Jennifer Lopez's production companies, about a New Orleans bounty hunter; American Digger from the producers of Spike's hit Auction Hunters, about a relic hunter digging up people's properties for histotic artifacts; and World's Worst Tenants from Zoo Prods., about a professional evictor. Additionally, Spike has ordered 20 more episodes of the SallyAnn Salsano-produced Repo Games. Sharon Levy, Spike's EVP original series, said that the new shows are part of the network's push to expand its core men 18-34 demo to the older men 34-49 demographic that was launched with such recent series as Auction Hunters, Bar Rescue and Repo Games. In primetime, Spike's median age is currently 40, up from 38 last year. The median age for the network's highest-rated unscripted original, Auction Hunters, is 41; for Bar Rescue it's 42. "We have had success in our quest to broaden out our audience," she said. "The new series continue that and hone our brand as a destination for dynamic characters that exist in high risk/high reward situations." The goal is to have 52 weeks of originals on Spike every year, she added. Here are detailed descriptions of the new series, including the sizes of their orders: There is treasure buried in the backyards of everyday Americans but they just dont know it until now. American Digger follows former professional wrestler turned modern day relic hunter Ric Savage, as he and his team from American Savage target areas such as battlefields and historic sites in the hopes of striking it rich and capitalizing on unearthing and selling bits of American history. The only thing standing in their way are the homeowners themselves, who Savage must convince to allow them to dig up their property using high-tech ground penetrating equipment and one very large bulldozer. What artifacts they find, they sell for a substantial profit, but not before negotiating a deal to divide the revenue with the property owners. The team from American Savage is comprised of Rics wife Rita, a New Jersey native, their 25-year old son Giuseppe who is the muscle of the operation and two artifact recovery experts, Rue Schumate and Bob Buttafuso. Spike TV has ordered 13 half-hour episodes of this new show created and produced by Gurney Productions (Auction Hunters). Centered in the fascinating and gritty underworld of post-Katrina New Orleans, Big Easy Justice follows legendary bounty hunter, Tat-2, and his Elite Fugitive Recovery Team, as they hunt down some of the citys most elusive criminals. With the support of local law enforcement, deep knowledge of the streets and an iron fist, Tat-2, a New Orleans native, has a single mission: keep his city safe by keeping the bad guys off the streets. Hardened by years of working such a dangerous job, Tat-2 shows no fear on the job and will utilize any means necessary, within the boundaries of the law, to apprehend his prey. Spike has ordered 10 half-hour episodes of the series, produced by Al Roker Entertainment in association with CRM Entertainment, with Jennifer Lopezs Nuyorican Productions, and Bodega Pictures. The series will premiere in 2012. For anyone with a nightmare neighbor, professional evictor and notorious tough guy Todd Howard is their savior. In Worlds Worst Tenants, Howard confronts the most despicable, dirty, outrageous, dangerous and insane tenants imaginable and forcibly removes them. He and his eviction team consisting of his wife, Randye, and his business partner, Rick, are hired to keep tabs on over 150 residential, commercial and retail units. Howard, who works in tandem with local law enforcement, is a former U.S. Marine who can back up his tough talk, if need be. When Howard and his team knock on the door, they never know what to expect and what kind of story will play out on the other side. If a situation gets violent, Howard is willing and able to take charge and gain control of the situation, even if it means using his legally concealed weapon. Spike has ordered 10 half-hour episodes of Worlds Worst Tenants, produced by Barry Poznick and John Stevens of Zoo Productions (Southern Fried Stings). From the producers of one of televisions landmark series, Cops, comes Undercover Stings, where viewers are taken inside the high-stakes world of orchestrated busts and undercover police sting operations, some of the most powerful and effective tools in the law-enforcement arsenal. From the initial planning and set-up, to the dramatic tactical process and the final execution of the takedown, Undercover Stings rides along with several of the top police departments in the business as they ply their trade and bust the crooks. Whether its drug sales and prostitution, or all the way up the criminal ladder to fraud, corruption, and murder-for-hire viewers get unprecedented access with the larger-than-life cops from around the country who specialize in high-pressure sting ops.
